By way of this criminal misc. petition under Section 528 of BNSS, the accused-petitioners have approached this Court with a prayer to quash the FIR No.273/2019 registered at Police Station Nadbai, District Bharatpur for the offence punishable under Section 380 of IPC along with entire criminal proceedings pending

in the Court of Additional Chief Judicial Magistrate, Nadbai, District Bharatpur in Case No.420/2021.

Learned counsel for the petitioners submits that impugned FIR was lodged on 09.05.2019 for the offence under Section 380 of IPC with regard to the theft of buffalo belonging to the complainant. It is submitted that after investigation, police submitted the complete final report against the two persons, namely, Suresh S/o Balram and Arshad S/o Aashu and report under Section 299 Cr.P.C. was filed against the petitioners. It is submitted that co-accused Suresh and Arshad have been acquitted vide judgment dated 30.06.2023. It is submitted that now, petitioner No.6, namely, Ratti S/o Sukkan has been arrested and presently, he is in judicial custody. Learned counsel contends that dispute has been resolved by the parties through mutual understanding and complainant of this case does not want to pursue the criminal proceedings arising out of impugned FIR. It is contended that looking to the fact that co-accused persons have been acquitted and parties have resolved their dispute amicably, further proceedings in the impugned FIR may be quashed and set aside.

Learned counsel for the complainant-respondent No.2 does not dispute the factum of compromise and he submits that proceedings against the petitioners pending in the trial Court arising out of impugned FIR may be quashed on the basis of compromise.

In view of the aforesaid and considering the submissions made on behalf of the respective parties; the material made available for perusal; considering the fact that parties have

resolved their dispute amicably and also finding that the present case is wholly covered by the principle of law laid down by Hon'ble the Supreme Court in the case of Gian Singh Vs. State of Punjab & Anr-reported in 2012 Cr.L.J. (SC) 4934 and in the case of State of Haryana & Ors. Vs. Choudhary Bhajan Lal & Ors. [ AIR 1992 SC 604 ] and as such, the aforesaid FIR along with entire criminal proceedings arising out of it is liable to be quashed in view of compromise arrived at between the parties.

In view of the above, this Criminal Misc. Petition is allowed and the FIR No.273/2019 registered at Police Station Nadbai, District Bharatpur for the offence punishable under Section 380 of IPC along with entire criminal proceedings pending in the Court of Additional Chief Judicial Magistrate, Nadbai, District Bharatpur in Case No.420/2021, is quashed and set aside. Consequence to follow.

Stay application and pending application(s), if any, also stand disposed of.

Petitioner No.6, Ratti S/o Sukkan, who is in judicial custody, shall be released forthwith, if not wanted in any other case.
