The petitioner has preferred this bail application under Section 483 of BNSS in FIR No.305/2022 registered at Police Station Jhalra Patan, District-Jhalawar for offences under Sections 420 and 406 of IPC, 1860.

Heard learned counsel for the petitioner as well as learned Public Prosecutor and perused the material available on record. 3. Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case. The present matter is civil in nature having financial transactions between the parties. As per the FIR, the complainant himself for the purpose of investment or profit-making made payment of the alleged amount to Pawan Jain (the husband of the petitioner) who, in lieu thereof, provided two cheques issued in the name of his wife as security to the complainant. He submits that the petitioner did not instigate the

victim to make any payment of the amount to the co-accused, Pawan Jain, and that she has been impleaded in the present case solely on the ground of issuance of the cheque. Though eight cases have been reported against the petitioner as criminal antecedent but in two cases negative final report has been submitted and in rest of the cases she has been bailed out. The petitioner is behind the bars since 21.05.2025. The trial of the case will take considerable time, therefore, no fruitful purpose would be served by keeping the petitioner in further custody and the bail application of the petitioner may be allowed.

Learned Public Prosecutor has vehemently opposed the bail application. 5. On consideration of the rival submissions and material available on record and in the light of submission made by learned counsel for the petitioner but without expressing any opinion on merits/demerits of the case, I am inclined to grant benefit of bail to the petitioner.

Consequently, the bail application under Section 483 B.N.S.S. is allowed and it is directed that the petitioner Maina Devi W/o Pawan Jain, be released on bail provided she furnishes a personal bond in the sum of Rs.50,000/- with two sureties in the sum of Rs.25,000/- each to the satisfaction of the learned trial court with the stipulation that she shall appear before that Court on all subsequent dates of hearing till conclusion of the trial.
