This bail application has been filed by the accused-petitioner under Section 483 of B.N.S.S. in connection with FIR No.651/2025 registered at Police Station kotwali Baran, District Baran for offence(s) under Section(s) 318(4), 303(2) and 3(5) of B.N.S.

Learned counsel for the petitioner submits that the accusedpetitioner has been falsely implicated in this case and he has no nexus with the alleged offences. Learned counsel further submits that the alleged offences are triable by the Magistrate; the petitioner is in custody since 03.12.2025; after investigation charge-sheet has been filed in the matter and no further recovery is required to be made from the petitioner. He also submits that conclusion of trial will take considerable long time, so no fruitful purpose would be served by keeping the petitioner in custody, therefore, prays to enlarge the petitioner on bail.

Per contra, learned Public Prosecutor opposes the bail application and submits that petitioner has nine criminal cases pending against him.

Having regard to the facts and circumstances of the case; considering the arguments advanced by learned counsel for the petitioner, the fact that the offences are triable by the Magistrate, charge-sheet has already been filed in the matter and trial will take considerable long time in its conclusion, thus, without commenting anything upon the merits / demerits of the case, this Court deems it just and proper to enlarge the petitioner on bail.

Therefore, this bail application is allowed and accused-petitioner Shashi Gupta S/o Mohan Lal Gupta is ordered to be released on bail, provided, he furnishes a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the trial Court, with the stipulation that the petitioner shall appear before that Court on all subsequent dates of hearing and as and when called upon to do so. 6. The accused - petitioner is directed to mark his presence before the concerned Police Station on 25^th date of every month till conclusion of trial. The SHO of the concerned Police Station shall forward petitioner's attendance report to the Trial court on the same day of each month. In case of any breach of the aforesaid conditions, the learned Public Prosecutor shall be at liberty to move an application against the petitioner for cancellation of bail before the concerned Court.
