Rishikesh S/O Shri Pitam Singh Vs State of Rajasthan

This bail application has been filed by the accused-petitioner under Section 483 of B.N.S.S. in connection with FIR No. 469/2025 registered at Police Station Mania, District Dholpur for offence under Sections 109(1), 115(2), 126(2), 189(2), 351 (2) & 351 (3) of B.N.S. 2. Learned counsel for the petitioner submits that the petitioner, who is an innocent person, has been falsely implicated in this case and he has no nexus with the alleged offences. Learned counsel further submits that the injuries are simple in nature and no allegation exists against the petitioner of causing injuries to the injured person. 09.02.2026 passed in S.B. Criminal Misc. Second Bail Application No. 2415/2026 and the case of petitioner is not different from that of co-accused.

Learned counsel also contends that the parties have already entered into compromise and after completion of investigation, the charge-sheet has already been filed in the matter. Learned counsel further submits that the petitioner is in custody since long; no recovery is required to be made from him and the trial will take considerably long time in its conclusion, so no fruitful purpose would be served by keeping the petitioner in custody, and therefore, prays that the petitioner may be granted the benefit of bail under Section 483 of B.N.S.S.

Per contra, learned Public Prosecutor vehemently opposes the submissions made by learned counsel for the petitioner hereinabove.

Mr. Rahul Singh, Learned counsel for the complainant does not dispute the factum of compromise arrived at between the parties and submits that the complainant has no objection if the petitioner is released on bail.

Taking into consideration the overall facts and circumstances of the case; the arguments advanced by learned counsel for both the parties, the fact that the injuries are simple in nature; compromise has been arrived between the parties, charge-sheet has already been filed in the matter and trial will take considerably long time in its conclusion, thus, without commenting anything on

merits / demerits of the case, this Court deems it just and proper to enlarge the petitioner on bail.

Therefore, this bail application under Section 483 of BNSS is allowed and accused-petitioner Rishikesh S/o Shri Pitam Singh is ordered to be released on bail, provided, he furnishes a personal bond in the sum of Rs. 50,000/- with two sureties of Rs. 25,000/- each to the satisfaction of the trial Court, with the stipulation that the petitioner shall appear before that Court on all subsequent dates of hearing and as and when he is called upon to do so.
