These bail applications have been filed under Section 483 of BNSS on behalf of the petitioners, who have been arrested in connection with FIR No.708/2025 registered at Police Station Mathuragate, District Bharatpur for offences punishable under Sections 189(2), 126(2), 125 and 351(2) of BNS, 2023.

It is contended by learned counsel for the petitioners that the accused-petitioners have falsely been implicated in this case. Learned counsel submit that it is a case of no injury. They further submit that allegation of using firearm is against co-accused Sachin. They argue that co-accused of this case namely, Shiva has already been granted benefit of bail by a Co-ordinate Bench of this Court. They argue that there is no criminal antecedents against the petitioner – Ankit and there are six criminal antecedents against the petitioner – Akash @ Alvendra. They further contend that petitioner – Akash has been acquitted in two of those cases. They further submit that trial of the case will take considerable time in its conclusion. They further contend that the petitioners are in custody since their date of arrest and further custody of the petitioners would not serve any fruitful purpose.

Learned Public Prosecutor opposes the submissions made by the learned counsel for the petitioners, but fairly concedes that it is a case of no injury.

I have considered the contentions.

Having regard to the totality of the facts and circumstances of the case; considering the arguments advanced by learned counsel for the petitioners, especially the fact that there is no allegation against the petitioners of using any firearm, said allegation is against co-accused Sachin; charge-sheet has been filed and trial will take time in its conclusion as well as looking to the period of custody, but without commenting anything on the merits/demerits of the case, I deem it proper to allow these bail applications.

These bail applications are accordingly allowed and it is directed that accused-petitioners- (1). Ankit S/o Mukesh Chand, and (2). Akash @ Alvendra S/o Sukhvendra shall be released on bail provided, each of them furnishes a personal bond in the sum of Rs.1,00,000/- (Rupees One Lakh Only) together with two sureties in the sum of Rs.50,000/- (Rupees Fifty Thousand Only) each to the satisfaction of the learned trial Court with the stipulation that they shall appear before that Court and any Court to which the matter is transferred, on all subsequent dates of hearing and as and when called upon to do so.

Considering the criminal antecedents of the petitioner - Akash @ Alvendra S/o Sukhvendra, it is made clear that the accused-petitioner shall not involve in any other offence(s) during currency of the bail and he shall mark his presence in first week of every month in the concerned police station, till trial is concluded.

Concerned SHO shall record the presence of the petitioner in Roznamcha. In case the petitioner - Akash @ Alvendra S/o Sukhvendra fails to mark his presence in the concerned police station, as directed above, the concerned SHO is directed to immediately report the matter to the concerned Court in this regard.

If any breach of these conditions is reported or come to the notice of the Court, the same shall alone be a reason for the trial Court to cancel the bail granted to him by this Court.
