Apprehending their arrest in connection with FIR No.18/2026 registered at Police Station-Malpura, District-Tonk for the offences under Sections 189(2), 126(2), 115(2), 333 and 110 of BNS 2023, the petitioners have preferred this bail application under Section 482 BNSS.

Heard learned counsel for the petitioners, learned Public Prosecutor and counsel for the complainant and perused the material available on record.

Learned counsel for the petitioners submits that the petitioners have falsely been implicated in this case. It is further

submitted that the allegations against the present petitioners pertain to causing injuries to the injured persons, namely Altaf, Hussain, Abdul Samad, Mobina Bano, and Bino. However, none of the injuries are life-threatening or dangerous in nature. The allegations against the petitioners are baseless. They are willing to join and cooperate with the investigation and in compliance with the order dated 23.03.2026 passed by this Hon’ble Court, the petitioners have already joined the investigation and are fully cooperating with the investigating authorities. It is also submitted that a compromise has been amicably arrived at between the parties. Hence, the anticipatory bail application of the petitioners may be allowed.

Learned counsel for the complainant has acceded to the submissions made by learned counsels for the petitioners and has raised no objection if the anticipatory bail application of the petitioners may be allowed.

Learned Public Prosecutor has vehemently opposed the bail application.

Considering the fact that the compromise has arrived and the petitioners have joined the investigation and is cooperating with the investigation of the case and without commenting on the merits/demerits thereof, this Court deems it just and proper to allow the bail application of the petitioners.

Accordingly, the bail application under Section 482 BNSS is allowed and it is ordered that in the event of arrest of the petitioners- Umar S/o Abdul Rajjak, Aslam S/o Ajij and Sahil S/o Kayyum , they shall be released on bail on their furnishing a personal bond in the sum of Rs.50,000/- with two sureties in the

sum of Rs.25,000/- each of them to the satisfaction of the S.H.O/I.O/Arresting Officer of the concerned Police Station on the following conditions:-

(i) that the petitioners shall make themselves available for interrogation by a police officer as and when required; (ii) that the petitioners shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade them from disclosing such facts to the court or any police officer, and

¶31

(iii) that the petitioners shall not leave India without prior permission of the court.
