The petitioners have preferred these bail applications under Section 483 of BNSS in FIR No.177/2025 registered at Police

Station Ghar, District Tonk for offences under Sections 103(1) and 189(2) of BNS, 2023.

Since both these bail applications arise out of common FIR, hence, they are being decided by this common order.

Heard learned counsel for the petitioners as well as learned Public Prosecutor and perused the material available on record. 4. Learned counsel for the petitioners submits that the petitioners have falsely been implicated in this case. The alleged seizures are fake and fabricated in which the petitioners have no connection. He submits that the petitioners did not assault the deceased nor did they contribute in any way to cause the death of the deceased. Co-accused- Laxmi has been enlarged on bail by the Trial Court on 23.12.2025. Petitioners are behind the bars since 12.10.2025. The investigation in these cases have been completed and the charge-sheet has already been filed. The trial of the case will take considerable time and no fruitful purpose would be served by keeping the petitioners in further custody, consequently, the bail applications deserves to be allowed.

On the contrary, learned Public Prosecutor has vehemently opposed the bail application and submitted that the accusedpetitioners and others conspired to murder deceased-Suresh assaulting him with an axe, iron rod and wooden sticks. It is contended that the deceased-Suresh was severally beaten up and suffered with serious head and back injuries on his body due to which he died during treatment. It is also contended that the weapon used in the offence as well as blood stained clothes have been recovered from the petitioners. The allegations against the present petitioners grave and serious in nature. It is argued that

the name of the petitioners are prima facie established from the perusal of the FIR and there is incriminating material available on record, including the statements of the witnesses and their release would defeat the ends of justice. Therefore, the bail applications of the present petitioners are liable to be rejected.

On consideration of the rival submissions and material available on record and in light of the submissions made by learned Public Prosecutor, especially the fact that the names of the petitioners have been mentioned in the FIR as well as recovery of weapon used and blood stained clothes from the petitioners, this Court is of the view that petitioners does not deserve the indulgence of bail.

Accordingly, the bail applications under Section 483 B.N.S.S. are hereby dismissed.
