This bail application has been filed on behalf of the accusedpetitioners under Section 483 of B.N.S.S. in connection with FIR No. 242/2025 registered at Police Station Phagi, Distt. Jaipur Rural for the offence(s) under Section(s) 115(2), 126(2), 189(2) & 333 of BNS, in which charge-sheet has been filed under Section 115(2), 126(2), 109(2), 3(5) of BNS.

Learned counsel for the petitioner wants to withdraw the bail application of Dharmpal @ Ganesh S/o Ramniwas.

Accordingly, the present criminal misc. bail application of Dharmpal @ Ganesh S/o Ramniwas is dismissed as withdrawn.

Learned counsel for the petitioner namely Hanuman S/o Bhairuram submits that the petitioner has been falsely implicated in this case and the accused-petitioner is behind the bars since 05.02.2026, there are no criminal antecedents against the accused-petititoner Hanuman. He also submits that life threatening injury is not attributed to him . He further submits that charge-sheet against the accused-petititoners has already been filed and conclusion of trial will take its own time, so no fruitful purpose would be served by keeping the petitioner-Hanuman in custody and therefore, prays that the petitioner-Hanuman may be granted the benefit of bail under Section 483 of BNSS.

Per contra , learned Public Prosecutor vehemently opposes the submissions made by learned counsel for the petitioner hereinabove.

Having regard to the totality of the facts and circumstances of the case and considering the arguments advanced by learned counsel for the petitioner that charge-sheet has already been filed; there are no criminal cases registered against the petitionerHanuman; the accused-petitioner namely Hanuman is behind the bars since 05.02.2026; injury is dangerous to life is attributed to co-accused Dharampal @ Ganesh and trial will take its own time. Hence, this Court without expressing any opinion on the merits/demerits of the case deems it just and proper to enlarge the petitioner Hanuman on bail.

Therefore, this bail application under Section 483 BNSS is accordingly, allowed and the accused-petitioner Hanuman S/o Bhairuram is ordered to be released on bail, provided he furnishes a personal bond in the sum of Rs. 1,00,000/- with two

sureties of Rs. 50,000/- each to the satisfaction of the trial Court, with the stipulation that he shall appear before that Court and any court to which the matter is transferred on all subsequent dates of hearing and as and when called upon to do so.
