These bail applications have been filed on behalf of the accused-petitioners under Section 483 of BNSS in connection with FIR No. 158/2025 registered at Police Station Simliya, District Kota Rural for the offence(s) under Sections 126(2), 115(2), 109(1), 352 & 3(5) BNS, in which charge-sheet has submitted under Sections 126(2), 115(2), 109(1), 352, 3(5) & 118(2) BNS with respect to accused-petitioner Parmanand and under Sections

126(2), 115(2), 109(1), 352, 3(5) & 118(2) BNS and 4/25 of Arms Act with respect to accused-petitioner Banti @ Bintesh.

Learned counsel for the petitioners submits that the petitioners have been falsely implicated in this case; charge-sheet has already been filed; He further submits that petitioners are behind the bars since December, 2025. None of the injuries sustained by the injured is fatal; trial will take its own time, so no fruitful purpose would be served by keeping the petitioners behind the bars and, therefore, prays that the petitioners may be granted the benefit of bail under Section 483 of BNSS.

Per contra , learned Public Prosecutor vehemently opposes the bail application and submits that there are two other criminal antecedents registered against the accused-petitioner Parmanand and out of two, he has been convicted in one case under Section 307 IPC and there is one criminal antecedent against the accusedpetitioner Banti @ Bintesh. He further states that it is a case of multiple blows to the injured on his vital part and one of the injury is found to be of dangerous to life in nature.

Having regard to the totality of the facts and circumstances of the case and arguments advanced by both the parties and considering the fact that petitioner Parmanand caught hold of injured Omprakash while the co-accused persons Banti @ Bintesh and Ramavtar stabbed him on his stomach with multiple blows, one of the injury has been found to be dangerous to life which shows that petitioners had an intention to kill the injured. There are criminal antecedents against both the petitioners, and it is also pertinent to mention that petitioner Parmanand has been earlier convicted in one criminal case of a similar nature. So, considering

the fact that there is an allegation against the petitioners of causing life threatening injury on the vital part of the injured. Hence, this Court without expressing any opinion on the merits/demerits of the case does not deems it fit to enlarge the petitioners on bail.

Accordingly, the present Criminal Misc. Bail Application is dismissed .

The observation made hereinabove is only for decision of the instant bail application and would not have any impact on the trial of the case in any manner.
