The instant bail application has been filed by the accused petitioner under Section 483 BNSS in connection with FIR No. 0165/2025 registered at Police Station Bhabru, District Kotputali-Behror for offences under Sections 115(2), 127(2), 308(2), 140(4), 3(5) of BNS 2023 in FIR and against the order dated 02.01.2026 whereby learned Trial Court dismissed the bail application filed by the accused-petitioner for the offences Sections 140(2), 308(2), 115(2), 61(2) of BNS 2023.

Learned counsel for the accused petitioners submits that the accused-petitioner has been falsely implicated in the case. He further submits that F.I.R. has been lodged against unknown persons and after arrest of the accused-petitioner on the basis of the statements of the co-accused and no test identification parade was conducted to ascertain whether the

petitioner was actually involved in the commission of the offence. Counsel further submits that accused-petitioner is in custody since 27.10.2025 and police after completion of the investigation has submitted charge-sheet in the matter. Learned counsel also submits that two other co-accused namely; Ajay Kasana and Dhola Ram have already been enlarged on bail and the case of the accused-petitioner stands on a same footings.

Learned Public Prosecutor opposed the bail application. 4. On a query put to the learned Public Prosecutor as to whether test identification parade of the present petitioner was got conducted after his arrest ? The learned Public Prosecutor answered that no test identification parade was got conducted as the accused-petitioner was not produced with the covered face after his arrest.

Considered the submissions made by the counsel for the petitioner as well as learned Public Prosecutor. 6. No test identification parade has been got conducted so as to identify whether the accused-petitioner was involved in the crime or not. The other two co-accused namely; Ajay Kasana and Dhola Ram have already been enlarged on bail and the case of the petitioner is not distinguishable from the case of the coaccused Ajay Kasana.

Taking into consideration the overall facts and circumstances of the case and so also maintain the parity, this Court without expressing any opinion on merits and demerits of the case, deems just and proper to enlarge the accused-petitioner on bail.

Accordingly, this bail application is allowed and it is directed that accused-petitioner shall be released on bail provided that he furnishes a personal bond in the sum of Rs. 1,00,000/(Rupees One Lac Only), together with two sureties in the sum of Rs. 50,000/- (Rupees Fifty Thousand Only) to the satisfaction of the Trial Court with the stipulation that he shall appear before that Court or any Court to which the matter is transferred, on all subsequent dates of hearing and as and when called upon to do so.

Looking to the number of other criminal cases pending against the accused-petitioner it is made clear that in case the accused-petitioner is found to be involved in any other criminal case of similar nature in future, the trial court shall forfeit the bail bonds to be submitted by the accused-petitioner in furtherance of this order and this order shall stands automatically cancelled.
