The instant second bail application has been filed under Section 483 of B.N.S.S. on behalf of accused-petitioner. The accused-petitioner has been arrested in connection with FIR No.09/2025, registered at Police Station Special Operation Group (S.O.G.), Jaipur, District ATS and SOG, Jaipur, for the offence(s) under Sections 420, 467, 468, 471 and 120-B of IPC and Sections 3, 4, 6, 2(F)(ii) and 10 of Rajasthan Public Examination (Measures for Prevention of Unfair Means in Recruitment) Act, 2022.

It is contended by learned counsel for the petitioner that the accused-petitioner has falsely been implicated in this case. It is contended that the first bail application of the accused-petitioner was dismissed with liberty to file afresh after filing of the chargesheet. 04.02.2026 and there are on criminal antecedents against the accused-petitioner. The other co-accused namely, Dropadai Dropti Siyag, Manoj, Sangita Bishnoi, Sunita and Rakesh Kaswa have already been enlarged on bail. The alleged offences are under Sections 3, 4, 6, 2(F)(ii) and 10 of Rajasthan Public Examination (Measures for Prevention of Unfair Means in Recruitment) Act, 2022 and Sections 420, 467, 468, 471 and 120-B of IPC. It is further contended that there is no reliable or substantive evidence that the petitioner through Bluetooth was involved in cheating in the examination for the post of L.D.C. conducted on 12.03.2023, the petitioner is in custody since more than two months, further trial of the case may take considerable time, therefore, the bail application of the accused-petitioner may be allowed.

Learned Public Prosecutor has vehemently opposed the grant of the bail application and contended that the petitioner was involved in a racket of cheating and was found, facilitating the candidates who appeared in the examination in cheating through a Bluetooth device. Therefore, considering the aforesaid facts, the bail application of the accused-petitioner may be dismissed. 4. Heard and perused the material available on the record. 5. The other similarly placed co-accused namely, Dropadai Dropti Siyag, Manoj, Sangita Bishnoi, Sunita and Rakesh Kaswa have already been enlarged on bail. The accused-petitioner is in custody since long, there are no criminal antecedents against the accused-petitioner and the trial of the case may take considerable time, therefore, without expressing anything on the merits of this case, this Court deems it proper to enlarge the accused-petitioner on bail.

Accordingly, the instant second bail application under Section 483 of B.N.S.S. is allowed and it is ordered that the accusedpetitioner -Ramesh Kumar S/o Sh. Sarjeet Singh, in connection with FIR No.09/2025, registered at Police Station Special Operation Group (S.O.G.), Jaipur, District ATS and SOG, Jaipur, shall be enlarged on bail provided he furnishes a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the learned trial Judge for his appearance before the Court concerned on all the dates of hearing and as and when called upon to do so.
