The petitioner has preferred this bail application under Section 483 of BNSS in FIR No.347/2025 registered at Police Station Murlipura, District-Jaipur (West) for offences under Sections 103(1) and 61(2)(a) of BNS, 2023.

Heard learned counsel for the petitioner, learned Public Prosecutor as well as learned counsel for the complainant and perused the material available on record. 3. Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case. He further submits that on the day of the incident, the petitioner’s vehicle collided with another vehicle in respect of which FIR No. 347/2025 was

registered at Police Station Murlipura. At that time, the petitioner was attempting to avoid the incident and any controversy at the spot and was trying to leave the place, as the incident had occurred unintentionally. It is further submitted that the said incident occurred without any intention or motive on the part of the petitioner and was purely accidental in nature. He again submits that complainant of present case has arrived at a compromise which is evident from the impugned order. He further argued that there is no motive for such accident to resulting in death of the deceased Chandra Shekhar. Charge-sheet has already been filed. Petitioner is behind the bars since 18.08.2025. The trial of the case will take considerable time, therefore, no fruitful purpose would be served by keeping the petitioner in further custody and the bail application of the petitioner may be allowed.

Learned counsel for the complainant has consented to the submissions made by learned counsel for the petitioner and has raised no objection to the grant of bail to the petitioner. 5. Learned Public Prosecutor has vehemently opposed the bail application.

On consideration of the rival submissions and material available on record and in light of submission made by learned counsel for the petitioner but without expressing any opinion on merits/demerits of the case, I am inclined to grant benefit of bail to the petitioner.

Consequently, the bail application under Section 483 B.N.S.S. is allowed and it is directed that the petitioner Kuldeep Choudhary S/o Surendra Singh, be released on bail provided he furnishes a personal bond in the sum of Rs.50,000/- with two
