These bail applications have been filed under Section 483 of BNSS, 2023 on behalf of accused-petitioners in connection with FIR No.35/2026 registered at Police Station Bhiwadi, District Bhiwadi for the offences under Sections 115(2), 126(2), 109(1), 189(2), 191(2) and 191(3) of BNS, 2023.

Considered the submissions made by counsel for the petitioners as well as learned Public Prosecutor assisted by counsel for the complainant and also perused the case diary.

As per the contents of the FIR and so also statements of the injured-Surendra recorded under Section 180 of BNSS, 2023 the allegation is that the accused-Deepak @ Katiya hit the motorcycle of the injured-Surendra and the other accused-persons were sitting in the car (Scorpio).

The accused-petitioners, namely, Sidhant and Manohar have not been named in the FIR and the accused-petitioners are said to be in custody for last more than two months. As per the injury report of the injured-Surendra, he is said to have sustained as many as seven injuries by blunt object, out of which, one of the injury at his shoulder has been opined to be grievous and the remaining six injuries have been opined to be simple in nature.

Taking into consideration overall facts and circumstances of the case and so also the allegation against the accused-petitioners and more particularly the fact that the accused-petitioners,

namely, Sidhant and Manohar were neither named in the FIR nor in the statement of the injured and also the fact that only one injury which is on the shoulder of the injured has been opined to be grievous and the remaining injuries are opined to be simple in nature, this Court without expressing any opinion on the merits or demerits of the case, deems just and proper to enlarge the accused-petitioner on bail.

Accordingly, these bail applications under Section 483 BNSS are allowed and it is ordered that the accused-petitioners named above shall be enlarged on bail provided, each of them furnish a personal bond in the sum of Rs.1,00,000/- together with two sureties of Rs.50,000/- each to the satisfaction of the learned trial Judge for their appearance before the Court concerned on all the dates of hearing and as and when called upon to do so.
