The accused-petitioner has filed the present bail application under Section 483 B.N.S.S., 2023 in connection with F.I.R. 355/2025, registered with the Police Station Mundawar, District Khairthal-Tijara, for offence punishable under Section 103(1) and 238(a) of B.N.S., 2023.

The learned counsel for the accused-petitioner submits that the present accused-petitioner has been falsely implicated in this case on the basis of interrogation note of co-accused, Manoj. The learned counsel also submits that nothing incriminating has been recovered from the possession of the accused-petitioner so as to connect him with the alleged crime. He also submits that the police after completion of investigation, has submitted chargesheet in the matter; the petitioner is in custody since 22.07.2025

and trial of the case is likely to take considerable time to conclude, therefore, he may be enlarged on bail.

The learned Public Prosecutor has opposed the bail application and submits that the petitioner used to do black magic to cast a spell on someone. He further submits that during investigation, it has come out that co-accused, Manoj, approached the present accused-petitioner for settling the dispute in his family, for which the present petitioner asked him to bring the blood and heart pieces of his child and co-accused, Manoj, did so by putting his child, Lokesh, to death.

Considered the submissions made by the learned counsel for the petitioner as well as the learned Public Prosecutor and also perused the challan papers.

It has come out that the petitioner is involved in doing the black magic to cast spells on someone and in this regard the Sarpanch, Gram Panchayat Khanpur Ahir, Panchayat Samiti Mundawar (Alwar), has also given a letter to the police that the petitioner is involved in doing black magic.

In the information given under Section 23(2) of the Bharatiya Sakshya Adhiniyam, 2023, the accused-petitioner, Sunil Kumar, has disclosed that he asked co-accused, Manoj, to bring the blood and heart pieces of his niece for black magic to cast spell. In search, at the instance of the petitioner, several incriminating materials have been recovered.

Taking into consideration the overall facts and circumstances of the case and more particularly the facts collected during investigation and so also the nature and gravity of the act

and the offence, this Court is not inclined to enlarge the petitioner on bail.
