This miscellaneous bail application has been filed by the petitioner Sunil S/o Pokharram, aged about 36 years, who was arrested by the police in connection with the FIR bearing No.9/2026 dated 13.01.2026 registered at Police Station Dooni, District Tonk for the offences punishable under Sections 303(2), 223(a) of B.N.S., 2023 and Section 4/21 of Mines and Mineral (Development and Regulation) Act, 1957.

Learned counsel submitted that the bail application filed by the petitioner was rejected by the District & Sessions Judge, District Tonk vide order dated 27.01.2026, thereafter, the petitioner has preferred this bail application under Section 483 of B.N.S.S., 2023.

Learned counsel submits that the petitioner has not committed any offence and that he was transporting river sand and minerals for his livelihood. Learned counsel further submits that police after conducting the investigation has filed the charge-sheet and no more recovery is required to be made from the petitioner. In view thereof, learned counsel prayed that the petitioner be enlarged on bail.

Learned Public Prosecutor strongly opposed the bail application.

This court, after considering the overall facts and circumstances of the case and without commenting upon its merits, is inclined to exercise its power under section 483 B.N.S.S. and deems it just and proper to enlarge the accused-petitioner Sunil S/o Pokharram on bail.

Accordingly, the bail application filed under Section 483 B.N.S.S. is allowed and it is directed that accused-petitioner Sunil S/o Pokharram shall be released on bail, provided he executes a personal bond in a sum of Rs.1,00,000/-with two sound and solvent sureties of Rs.50,000/- to the satisfaction of learned trial Court for his appearance before that Court on each and every date of hearing and whenever called upon to do so till the completion of the trial. The petitioner is further directed not to take undue advantage of liberty or misuse liberty. It is made clear that the observation as made by this Court in the bail application will not affect the trial of the case.
