In S.B. Criminal Miscellaneous Bail Application No. 12509/2025:-

The instant bail application has been filed by the petitioners Hemant S/o Prabhulal, in connnection with the FIR bearing No.176/2025 dated 19.08.2025 registered at Asnawar, District Jhalawar for the following offences punishable under Sections 8/21 and 29 of the N.D.P.S. Act, 1985.

Learned counsel for the petitioner submits that he has been falsely implicated in the present case. He submits that the complete allegations are completely baseless and false and the police after conducting the charge-sheet has filed the chargesheet and no more recovery is required to be made.

As far as the antecedents as mentioned by the learned Trial Court in the bail rejection order he submitted that the order contains details of as many as eight cases, out of which, three are of the N.D.P.S. Act, 1985. He further submits that in two cases bearing No.232/2014 and 62/2017 as mentioned in the order he has already been acquitted by the learned Trial Court. He further submits that as far as the third case of the N.D.P.S bearing No.26/2021 is concerned, he has already been enlarged on bail by the Co-ordinate Bench of this Court.

Learned counsel further submits that in another case of the Scheduled Caste and Scheduled Tribe Act, 1989 he has been acquitted and there are no serious cases pending against him. In

view thereof, he prayed that the petitioner may be enlarged on bail by this Court.

Learned Public Prosecutor strongly opposed the bail application, however, he could not dispute the fact that he has been acquitted in two N.D.P.S cases and in the third one he has already been enlarged on bail on the ground that the alleged contraband substance as recovered was less than the commercial quantity.

This Court considered the contents of the FIR as well as the charge-sheet and the fact that he had already been acquitted in two N.D.P.S. cases and in the third one he has been enlarged on bail on the ground that the alleged contraband substance was less than the commercial quantity. 7. Without making any comments on the merits of the case, this Court is inclined to enlarge the present petitioner on bail. Consequently, this Bail application is allowed. 8. Accordingly, the bail application filed under Section 483 B.N.S.S. is allowed and it is directed that accused-petitioner Hemant S/o Prabhulal shall be released on bail, provided he executes a personal bond in a sum of Rs.1,00,000/-with two sound and solvent sureties of Rs.50,000/- to the satisfaction of learned trial Court for his appearance before that Court on each and every date of hearing and whenever called upon to do so till the completion of the trial. The petitioner is further directed not to take undue advantage of liberty or misuse liberty. It is made clear that the observation as made by this Court in the bail applications will not affect the trial of the case.

It is further directed that in case, the petitioner is found to be involved in any case of similar nature within a period of two years from the date of passing of this order, learned Public prosecutor shall file an application for cancellation of the bail, without any fail.

In S.B. Criminal Miscellaneous Bail Application No. 811/2026

The instant bail application has been filed by the petitioners Anjana Bai W/o Banwari Bheel, Mamta Bai W/o Phoolchand Singh Bheel, Geeta Bai W/o Sohanlal Bheel and Kaila Bai W/o Sujan Singh Bheel, who are all females, who were present in the vehicle from which the police recovered the alleged contraband substance.

Learned counsel for the petitioners submit that the females were just present in the vehicle as they were traveling from one place to another, they are not at all connected with the accusedpetitioners herein. In view thereof, after filing of the charge-sheet, no recovery is required to be made from them, they may be enlarged on bail.

Learned Public Prosecutor opposed the bail application.

This Court considered the contents of the FIR, heard the learned Public Prosecutor and noted that there are no criminal antecedents of the petitioners herein, who are all females. Without making any comments on the merits of the case, this Court is inclined to enlarge the present petitioners on bail. Consequently, the bail application is allowed.

Accordingly, the bail application filed under Section 483 B.N.S.S. is allowed and it is directed that accused-petitioners Anjana Bai W/o Banwari Bheel, Mamta Bai W/o Phoolchand Singh Bheel, Geeta Bai W/o Sohanlal Bheel and Kaila Bai W/o Sujan Singh Bheel shall be released on bail, provided they execute a personal bond in a sum of Rs.1,00,000/-with two sound and solvent sureties of Rs.50,000/- to the satisfaction of learned trial Court for their appearance before that Court on each and every date of hearing and whenever called upon to do so till the completion of the trial.
