This bail application has been filed by the accused petitioner under Section 483 BNSS in connection with FIR No. 131/2025 registered at Police Station Basdayal, District Kotputli Behror for offences under Sections 189(2), 115(2), 126(2), 303(2) and 308(2) of BNS.

Learned counsel for the accused petitioner submits that the accused petitioner has been falsely implicated in this case. He further submits that though the injured has sustained injury on his head and that has been found to be simple in nature. He also submits that the injured has not sustained any grievous injury on the vital part of the body. He further submits that the only injury which has been opined to be grievous, is on the finger of right hand. He also submits that the accused-petitioner is in custody since 30.12.2025 and the co-accused, namely, Roopsingh @

Titusingh has already been enlarged on bail and the case of the present accused-petitioner is in no manner distinguishable from the case of co-accused who has been enlarged on bail.

Learned Public Prosecutor assisted by counsel for the complainant vehemently opposed the bail application. 4. Taking into consideration the overall facts and circumstances of the case so also the submissions made by the counsel for the accused-petitioner and more particularly the fact that no grievous injury has been found on vital part of the injured, this Court without expressing any opinion on merits or demerits of this case, deems just and proper to enlarge the petitioner on bail.

Accordingly, this bail application is allowed and it is directed that accused-petitioner shall be released on bail provided that he furnishes a personal bond in the sum of Rs. 1,00,000/- (Rupees One Lac Only), together with two sureties in the sum of Rs. 50,000/- (Rupees Fifty Thousand Only) to the satisfaction of the Trial Court with the stipulation that he shall appear before that Court or any Court to which the matter is transferred, on all subsequent dates of hearing and as and when called upon to do so.
