This bail application has been filed by the accused-petitioner under Section 483 of B.N.S.S. in connection with FIR No.0003/2026 registered at Police Station Fatehpur Kotwali, District Sikar for the offence(s) under Section(s) 305(a), 331(4) of B.N.S.

Learned counsel for the petitioner submits that the accusedpetitioner is an innocent person of 25 years of age and is preparing for the UPSC competitive examination. Counsel submits that the alleged incident occurred on 30.12.2025, however the FIR was lodged after a delay of five days i.e. on 04.01.2026 and petitioner is behind the bars since 05.01.2026. Learned counsel further submits that as per prosecution, a sum of Rs.13 lac and a motorcycle have already been recovered, and no further recovery is required to be made from the petitioner. Counsel also submits

that the alleged offences are triable by Magistrate and petitioner has no criminal antecedent. He, therefore, prays that the petitioner may be enlarged on bail.

Learned Public Prosecutor opposes the bail application.

Taking into consideration the overall facts and circumstances of the case; considering the arguments advanced by learned counsel for the petitioner, particularly the fact that the offences are triable by Magistrate and there exists no criminal antecedent against the petitioner and the trial is likely to take considerable time in its conclusion, without commenting anything on the merits of the case, this Court deems it just and proper to enlarge the petitioner on bail.

Therefore, this bail application is allowed and accusedpetitioner Kamal Pareek S/o Shankar Lal is ordered to be released on bail, provided he furnishes a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the trial Court, with the stipulation that the petitioner shall appear before that Court on all subsequent dates of hearing and as and when called upon to do so.

The observation made hereinabove is only for decision of the instant bail application and would not have any impact on the trial of the case in any manner.
