The instant appeal has been filed under Section 14-A SC/ST (Prevention of Atrocities) Act on behalf of the appellant, who is in custody in connection with F.I.R. No. 208/2021 Police Station Khetri, District Jhunjhunu, for the offence(s) punishable under Section(s) 420, 406 & 120B I.P.C. and Section 3(2)(va) of the SC/ST (Prevention of Atrocities) Act.

Learned counsel for the appellant submits that the accusedappellant has falsely been implicated in the case and he has nothing to do with the alleged offences. Learned counsel further submits that name of the appellant is not even mentioned in the F.I.R. and he has no criminal antecedent as well. The case is

triable by a Court of Magistrate. Learned counsel further submits that the other co-accused person, namely Rajesh Kumar, has already been enlarged on bail by a Co-ordinate Bench of this Court vide order dated 22.08.2024 in S.B. Criminal Appeal (Sb) No.1295/2024. The accused-appellant is behind bars since 28.12.2025. Learned counsel submits that charge-sheet has not been filed in the matter and the investigation as well as trial is likely to take considerable time to conclude. Learned counsel, therefore, prays that looking to the overall facts & circumstances of the case, the accused-appellant may be given the benefit of bail.

Per contra , learned Public Prosecutor and learned counsel for the complainant have vehemently opposed the submissions made hereinabove.

Heard learned counsel for the parties and perused the material available on record.

Having regard to the totality of facts & circumstances and upon consideration of the submissions made at Bar, more particularly that the case is triable by a Court of Magistrate and the appellant has no criminal antecedent, this Court is of the opinion that the appellant deserves to be enlarged on bail.

Consequently, the instant appeal is allowed . The impugned order dated 05.01.2026 passed by the Special Judge, SC/ST (Prevention of Atrocities) Cases, Jhunjhunu, in Criminal Bail Application No. 02/2026, is set aside. It is ordered that the accused-appellant, namely Sunil Kumar S/o Shri Ramniwas, arrested in connection with aforesaid F.I.R. , shall be released on

bail, if not wanted in any other case, provided he furnishes a personal bond of Rs. 1,00,000/- and two sureties of Rs. 50,000/each to the satisfaction of the learned trial Court with the stipulation to appear before that Court on all dates of hearing and as and when he is called upon to do so.
