The instant bail application has been filed under Section 483 BNSS on behalf of accused-applicant. The accused-applicant was arrested in connection with FIR No. 74/2025 registered at Police Station Garhmora District Karauli for the offence(s) under Sections 8/21, 8/25 and 8/29 of NDPS Act.

Learned counsel for the accused-applicant submits that the applicant is sole bread earner of the family, aged about 26 years. It is submitted that applicant is in custody ever since 27.12.2025. It is next submitted that recovered quantity of the contraband is much less than that of the commercial quantity. Learned counsel further submits that the conclusion of trial is likely to take a long time and no useful purpose would be served by keeping the applicant behind bars till disposal of the case.

Per contra , learned Public Prosecutor has vehemently opposed the instant bail application. It is submitted that there are two criminal antecedents of similar nature registered against the accused-applicant.

Having heard the arguments advanced by the learned counsel for the parties and taking note of the fact that accusedapplicant is a young man aged about 26 years; that the applicant is sole bread earner of the family; that accused-applicant is behind bars ever since 27.12.2025; that the recovered quantity of the contraband is much less than the commercial quantity and looking to the overall facts and circumstances of the case and material on record but without commenting on merits/demerits of the case, this court is inclined to allow the bail application of the accusedapplicant and enlarge him/her on bail.

Accordingly, the instant bail application under Section 483 BNSS is allowed and it is ordered that accused-applicant Mahendra Singh S/o Mohar Singh shall be enlarged on bail provided he furnishes a personal bond of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of learned trial Judge for his appearance before the court concerned on all the dates of hearing as and when called upon to do so.
