The present bail application has been filed by the accusedpetitioners under Section 483 of B.N.S.S. in connection with F.I.R. No.0012/2023 registered at Cyber Police Station Baran, District Baran for the offence(s) punishable under Section(s) 420, 406 of IPC and Section 66-D of I.T. Act.

Learned counsel for the petitioners submits that the petitioners are innocent persons and have been falsely implicated in this case as they have nothing to do with the alleged offences. Learned counsel further submits that the allegation is attributable to Mr. Pankaj Kewat, who is the main accused of the alleged incident. Counsel also submits that the only allegation against the petitioners is that their bank accounts were used for withdrawal of the amount. He further submits that the petitioners have no criminal antecedents and the alleged offences are triable by

Magistrate. Counsel also submits that the petitioners are in custody since long; charge-sheet has already been filed in the matter and no recovery is required to be made from them, so no fruitful purpose would be served by keeping them into custody. He, therefore, prays that the petitioners may be enlarged on bail.

Learned Public Prosecutor opposes the submissions made by learned counsel for the petitioners hereinabove.

Heard learned counsel for both the parties and perused the material available on record. 5. Taking into consideration the overall facts & circumstances of the case; the arguments advanced by learned counsel for the petitioners, the fact that the alleged offences are triable by Magistrate, the charge-sheet has already been filed and petitioners have no criminal antecedents as well as trial will take considerable time in its conclusion, thus, without commenting anything upon the merits / demerits of the case, this Court deems it just and proper to enlarge the petitioners on bail.

Therefore, the bail application under Section 483 B.N.S.S. is allowed and the accused-petitioners namely, Aakash Kumar S/o Omveer Singh and Monu Kumar S/o Sureshchand, are ordered to be released on bail, provided each of them furnish a personal bond in the sum of Rs.1,00,000/- with two sureties of Rs.50,000/- each to the satisfaction of the trial Court, with the stipulation that the petitioners shall appear before that Court on all subsequent dates of hearing and as and when he is called upon to do so.
