The present bail application has been filed by the accusedpetitioner under Section 483 of B.N.S.S. in connection with F.I.R. No.693/2025 registered at Police Station Kumher, District Deeg for the offence punishable under Section 309(4) B.N.S.

Learned counsel for the petitioner submits that the petitioner has been falsely implicated in this case and has nothing to do with the alleged offences. Learned counsel further submits that the petitioner is in custody since 09.11.2025; the charge-sheet has been filed in the matter and no recovery is required to be made from the petitioner, so no fruitful purpose would be served by keeping him in custody. Learned counsel also submits that the case is triable by a Court of Magistrate and therefore, prays that the petitioner may be granted the benefit of bail under Section 483 of the B.N.S.S.

Taking into consideration the overall facts & circumstances of the case; the arguments advanced by learned counsel for both the parties and the fact that charge-sheet has been filed and case is triable by a Court of Magistrate as well as trial is likely to take considerable time in its conclusion, thus, without commenting anything upon the merits / demerits of the case, this Court deems it just and proper to enlarge the petitioner on regular bail.

Therefore, the bail application under Section 483 B.N.S.S. is allowed and the accused-petitioner, namely Prashant S/o Udaiveer, is ordered to be released on bail, provided he furnishes a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the Trial Court, with the stipulation that the petitioner shall appear before that Court on all subsequent dates of hearing and as and when he is called upon to do so.
