This bail application has been filed by the accused petitioner u/S 482 BNSS in connection with FIR No. 99/2025, registered with the Police Station, Indergarh, District Bundi for offence punishable u/S 125 of B.N.S. 2023 and u/S 3 of Prevention of Damage to Public Property Act, 1984.

Considered the submissions made by the learned counsel for the accused-petitioner as well as the learned Public Prosecutor.

Learned counsel for the accused-petitioner submits that the complainant has lodged the criminal case with the averments that while there were patrolling in the official jeep three persons were on motorcycle throw stones towards them which caused damaged to the jeep. He further submits that the Police has already arrested three persons and now they are taking name of the

petitioner also.

Learned counsel for the petitioner also submits that the allegation is against the three persons and the police has already arrested them then implicating the petitioner as an accused is in no manner justified.

Learned Public Prosecutor opposed the bail application, however, he is not in a position to show why the forth person is being implicated as an accused when all three persons has already been arrested in this case.

Having regard to the submissions made by the learned counsel for the accused-petitioner and taking into consideration the allegations levelled against the accused-petitioner, this Court deems just and proper to extend the benefit of the anticipatory bail to the petitioner.

Accordingly, this Anticipatory Bail Application is allowed. The S.H.O./I.O./Arresting Authority, Police Station, Indergarh, District Bundi in F.I.R. No. 99/2025 is directed that in the event of arrest of the petitioner he shall be released on bail, provided he furnishes a personal bond in the sum of Rs.1,00,000/- (Rupees One Lac only) together with two sureties in the sum of Rs.50,000/- (Rupees Fifty Thousand only) each to his satisfaction on the following conditions:-

(i) that the petitioner shall make himself available for interrogation by a police officer as and when required;

(ii) that the petitioner shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from

disclosing such facts to the Court or any police officer, and

¶31

(iii) that the petitioner shall not leave India without previous permission of the Court.
