This bail application has been filed by the accused-petitioner under Section 483 of B.N.S.S. in connection with FIR No. 147/2023 registered at Police Station Basedi, District Dholpur for offence under Section 382 IPC. However, after investigation, the Investigating Agency has found that offences under Section 395 IPC and Section 11 of R.D.A.A. Act are made out against the petitioner.

Learned counsel for the petitioner submits that the petitioner, who is an innocent person, has been falsely implicated in this case and he has nothing to do with the alleged offence. Learned Counsel further submits that co-accused namely Naresh, Ravi and Bantu have already been enlarged on bail by this Court vide orders dated 22.11.2023, 21.08.2024 and 04.11.2024 passed in S.B. Criminal Misc. Second Bail Application No. 13962/2023, S.B. Criminal Misc. Bail Application No. 10244/2024 and S.B.

Criminal Misc. Bail Application No. 12947/2024 respectively and the case of petitioner is not different from that of the co-accused. Learned counsel also submits that the petitioner is in custody since long; charge-sheet has already been filed in the matter and no recovery is required to be made against the petitioner. Learned Counsel further submits that the trial of the case will take considerably long time, so no fruitful purpose would be served by keeping him in custody, and therefore, prays that the petitioner may be granted the benefit of bail under Section 483 of B.N.S.S.

Per contra, learned Public Prosecutor vehemently opposes the submissions made by the learned counsel for the petitioner hereinabove and also contended that seven other criminal cases have already been registered against the petitioner.

Taking into consideration the overall facts and circumstances of the case; the arguments advanced by learned counsel for the petitioner, the facts that charge-sheet has been filed; co-accused namely Naresh, Ravi and Bantu have already been enlarged on bail by this court; trial will take considerably long time in its conclusion, thus, without commenting anything on merits / demerits of the case, this Court deems it just and proper to enlarge the petitioner on bail.

Therefore, this bail application under Section 483 of BNSS is allowed and accused-petitioner Tahseela @ Tehsildar S/o Soneram is ordered to be released on bail, provided, he furnishes a personal bond in the sum of Rs. 50,000/- with two sureties of Rs. 25,000/- each to the satisfaction of the trial Court, with the
