Petitioner has filed this bail application under Section 483 B.N.S.S., arising out of F.I.R. No.07/2023 registered with the Police Station Cyber Police Thana (Baran), District Baran for offence under Sections 420, 406 & 120-B of IPC and Sections 66(C) & 66(D) of I.T. Act.

Learned counsel for the petitioner submits that there was some dispute with regard to money transaction between the complainant and the accused petitioner and the same has been shorted out and the money which was due to be paid to the complainant has already been paid as is evident from the statements of the complainant recorded under Section 161 Cr.P.C.

on 19.05.2023. He further submits that co-accused namely; Anil Bairagi S/o Laturlal has already been enlarged on bail by this Court vide order dated 02.09.2024. He also submits that the accused petitioner is in custody since 17.06.2025 and after conclusion of investigation, the Police has submitted charge-sheet in the matter, therefore, the accused-petitioner may be released on bail.

Learned Public Prosecutor has vehemently opposed the bail application.

Considered the submissions made by counsel for the petitioner as well as learned Public Prosecutor.

Taking into consideration the submissions made by learned counsel for the petitioner and the statement of the complainant recorded under Section 161 Cr.P.C., wherein he does not want any further action in this case and more particularly the fact that co-accused namely; Anil Bairagi S/o Laturlal has already been enlarged on bail by this Court vide order dated 02.09.2024, this Court without expressing any opinion on the merits and demerits of the case, deems just and proper to enlarge the petitioner on bail.

This bail application is, accordingly, allowed and it is directed that accused-petitioner shall be released on bail provided he furnishes a personal bond in the sum of Rs.1,00,000/- (Rupees One Lac only) together with two sureties in the sum of Rs.50,000/- (Rupees Fifty Thousand only) each to the satisfaction of the trial Court with the stipulation that he shall appear before
