This bail application has been filed on behalf of the accusedpetitioner under Section 483 of BNSS in connection with FIR No. 26/2023 registered at Police Station Angai, District Dholpur for the offence(s) under Sections 143, 332, 353 & 307 of IPC, under Sections 3, 5 & 25 of Arms Act, under Section 11 of R.D.A. Act and under Section 3 of Prevention of Damage to Public Property Act, 1984.

Learned counsel for the petitioner submits that the petitioner has been falsely implicated in this case; charge-sheet has already been filed; He further submits that similarly situated co-accused persons namely Bhola @ Ramkumar, Ravi @ Ravindra and Ashok has been enlarged on bail by the Co-ordinate Bench of this Court, vide orders dated 30.07.2025, 12.03.2025 and 29.09.2023 in S.B.Criminal Miscellaneous Bail Application Nos. 8477/2025,

9696/2024 and 11645/2023 respectively ; Further, he submits that none of the injuries sustained by the injured are dangerous to life; petitioner is behind the bars since 22.11.2025; conclusion of trial may take a long time, so no fruitful purpose would be served by keeping the petitioner behind the bars and, therefore, prays that the petitioner may be granted the benefit of bail under Section 483 of BNSS.

Per contra , learned Public Prosecutor vehemently opposes the bail application and submits that there are sixteen other criminal antecedents registered against the accused-petitioner.. 4. Having regard to the totality of the facts and circumstances of the case and considering the fact that charge-sheet has been filed; similarly situated co-accused persons namely Bhola @ Ramkumar, Ravi @ Ravindra and Ashok has been enlarged on bail by the Co-ordinate Bench of this Court; petitioner is behind the bars since 22.11.2025; trial will take its own time. Hence, this Court without expressing any opinion on the merits/demerits of the case, deems it just and proper to enlarge the petitioner on bail.

Therefore, this bail application under Section 483 BNSS is accordingly, allowed and the accused-petitioner Bantu @ Banti @ Gajendra Singh is ordered to be released on bail, provided he furnishes a personal bond in the sum of Rs. 1,00,000/- with two sureties of Rs. 50,000/- each to the satisfaction of the trial Court, with the stipulation that he shall appear before that Court and any court to which the matter is transferred, on all subsequent dates of hearing and as and when called upon to do so.
