The petitioners have preferred this bail application under Section 483 of BNSS in FIR No.48/2025 registered at Police Station Gangdhar, District Jhalawar for offences under Sections 8 and 18 of NDPS Act, 1985.

Heard Mr. Ishwar Singh (brother of the petitioners) as well as learned Public Prosecutor and perused the material available on record.

Mr. Ishwar Singh submits that the petitioners have falsely been implicated in this case. He states that nothing has been recovered from any of the petitioners. He further submits that the

co-accused Raju @ Hariom from whom recovery was effected has already been enlarged on bail by this Court vide order dated 28.07.2025. He further submits that the alleged contraband is 2 kg and 90 grams of opium, which is below the commercial quantity. Petitioners are behind the bars since 05.01.2026 without any criminal past. The trial of the case will take considerable time, therefore, no fruitful purpose would be served by keeping the petitioners in further custody and the bail application of the petitioners may be allowed.

Learned Public Prosecutor has vehemently opposed the bail application. 6. On consideration of the rival submissions and material available on record and in light of submission made on behalf of the petitioners but without expressing any opinion on merits/demerits of the case, I am inclined to grant benefit of bail to the petitioners.

Consequently, the bail application under Section 483 B.N.S.S. is allowed and it is directed that the petitioners Shiv Singh S/o Shambhu Singh and Jagdish Soni S/o Gangaram,

shall be released on bail on their furnishing a personal bond in the sum of Rs.50,000/- with two sureties in the sum of Rs.25,000/each to the satisfaction of the learned trial court for their appearance before the Court on all the dates till conclusion of the trial.
