This criminal appeal under Section 14 of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989 (hereinafter to be referred as 'the SC/ST Act’) has been filed on behalf of the appellant being aggrieved with the order dated 19.12.2025 passed by the learned Special Judge, (S.C./S.T. Prevention of Atrocities Cases), Sikar (hereinafter to be referred as ‘trial court’) in FIR No. 247/2025 registered at Police Station Ranoli, District Sikar for the offence under Sections 189(2), 115(2), 126(2), 140(3)of BNS, 2023 and Sections 3(1)(e), 3(2)

(va) of SC/ST Act, 1989 and Section 66 of IT Act, 2008, whereby the trial court has dismissed the bail application filed on behalf of the appellant.

Heard Mr. Ramnath (father of the petitioner) and learned Public Prosecutor and perused the material on record.

None appears on behalf of the complainant despite service. 4. Mr. Ramnath (father of the petitioner) submits that the appellant has falsely been implicated in this case. He again submits that the appellant has not been named in the FIR. He further submits that none of the injuries have been specifically attributed to the present appellant. The appellant is in custody since 07.12.2025 without any criminal past. Therefore, the appeal presented by the present appellant may be allowed.

Learned Public Prosecutor has vehemently opposed the appeal.

Considering the facts and circumstances of the case and without commenting anything on the merits/demerits of the case, I deem it just and proper to allow the appeal filed by the appellant under Section 14 of SC/ST Act.

Accordingly, this criminal appeal filed under Section 14 of SC/ST Act is allowed and order dated 19.12.2025 passed by the learned trial court is set aside. It is directed that appellant-
