The present bail application has been filed under Section 483 of BNSS, 2023 against the order dated 01.07.2026 passed by the learned Additional Sessions Judge (Women Atrocities Cases)

Ajmer, in Criminal Misc. Case (CIS) No.721/2026, whereby the bail application of the petitioners was rejected in connection with F.I.R. No.205/2026, Police Station-Ramganj, District-Ajmer for the offences under Sections 115(2), 126(2), 74, 79, 331(6), 324(5), 324(6), 351(2), 352, 189(3), 190, 191(2), 191(3), 309(4), 61(2) (A) of BNS, 2023.

Learned counsel for the petitioners submits that the petitioners are in custody since 18.06.2026. He further submits that the challan in the case has already been filed, offences are triable by Magistrate, the conclusion of trial will take sufficiently long time. He further submits that as per the injury reports sustained by the victims are simple in nature. He also submits that the petitioners have not named in the FIR and, therefore, he prays that the petitioners may be enlarged on bail.

Learned Additional Government Advocate vehemently opposes the present bail application. 4. Heard learned counsel for the petitioners as well as the learned Additional Government Advocate and perused the material available on record.

Without expressing any opinion on the merits of the case and upon a consideration of the fact that the petitioners are in custody since 18.06.2026; offences are triable by Magistrate; the challan has been filed; investigation/trial will take considerable time, the petitioners are not named in the FIR, the nature of the injuries and the fact that petitioner Nos. 1, 2, 4, 6, and 7 have no criminal antecedents. However, petitioner Nos. 3 and 5 each have one criminal antecedent, which pertains to cases that are more than

eight years old, this Court is of the opinion that the bail application filed by the petitioners deserve to be accepted.

Consequently, the bail application is allowed . It is ordered that the accused-petitioners namely- (i) Bhavesh S/o Shri Bhagchand (ii) Yash S/o Shri Dhanraj (iii) Amit S/o Shri Bhagchand (iv) Tushar S/o Shri Kisha (v) Netrapal S/o Late Shri Narendra Singh (vi) Abhay S/o Late Shri Jaiprakash & (vii) Sunil S/o Shri Ramkaran arrested in connection with F.I.R. No.205/2026, Police Station-Ramganj, District-Ajmer, shall be released on bail; provided each of them furnish a personal bond of Rs.1,00,000/ (Rs. One Lakh Only) with two sureties of Rs. 50,000/- (Rs. Fifty Thousand Only) each, to the satisfaction of the learned Trial Court, with the stipulation that they shall appear before the said Court on all dates of hearing and as and when called upon to do so until completion of the trial, subject to the following conditions:

(i) The petitioners shall not leave country without the permission of the Court;

¶32

(ii) The petitioners shall not commit any offence similar to the offence of which they are accused, or suspected, of the commission of which they are suspected;

(iii) The petitioners shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or to any police officer or tamper with the evidence.
