This bail application has been filed by the petitioner under Section 483 of BNSS in connection with FIR No.435/2025 registered at Police Station Sadar Dholpur, District Dholpur for the offences punishable under Section 115(2), 126(2), 352, 109(1) & 3(5) of BNS.

It is submitted by learned counsel for the petitioner that none of the injuries sustained by injured, have been opined dangerous to life and so far as allegations of possessing firearm ( desi katta ) are concerned, recovery thereof has been made from Ram Kishan alias Satoli, Soneram and not from the petitioner. It is further submitted that the petitioner has falsely been implicated only on account of being present at the site of incident, whereas no such offence has been committed by him. submits that the petitioner is behind the bar since 30.11.2025 and is not required for any recovery or further investigation.

Learned Public Prosecutor vehemently opposed the bail application and submitted that investigation is still going on. 4. Having considered the submissions made at bar and after perusing the case diary, it comes out that the injuries sustained by the injured have not been opined as dangerous to life in ordinary course of nature and recovery of 'desi katta' (firearm) is also not from the petitioner and the co-accused namely Ravindra Singh has already been enlarged on bail by the Co-ordinate Bench of this Court vide order dated 16.12.2025 passed in CRLMB No. 16422/2025.

In view of the submissions made by learned counsel for the petitioner, this Court without expressing any opinion on the merits and demerits of the case, deems it just and proper to enlarge the petitioner on bail.

Accordingly, this bail application is allowed and it is directed that accused-petitioner shall be released on bail provided that he furnishes personal bonds in the sum of Rs. 1,00,000/- (Rupees One Lac Only) each, together with two sureties in the sum of Rs. 50,000/- (Rupees Fifty Thousand Only)(each) to the satisfaction of the Trial Court with the stipulation that he shall appear before that Court or any Court to which the matter is transferred, on all subsequent dates of hearing and as and when called upon to do so.
