The matter comes upon an application No. 19/2026 in S.B. Criminal Revision Petition No. 173/2006 titled as Sabuddin & Anr. Vs. State of Rajasthan, by which the revision petition filed by the accused-applicant against the judgment dated 07.02.2006 passed by learned Special Judge, Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Cases and Additional District & Sessions Judge, Sawai Madhopur, was partly allowed and following order was passed by this Court vide order dated 02.07.2025:-

"11. In view of the aforesaid discussions and the fact that the petitioner has served the sentence of about 40 days, the prayer made on behalf of the petitioner is accepted and the present petition is partly allowed. While maintaining the conviction of the petitioner for the offences punishable under Section 498-A of IPC, the sentence awarded against him is ordered to be reduced and modified to the extent of sentence already undergone by him.

However, the amount of fine is hereby maintained.

It is ordered that the amount of fine i.e. Rs.1,000/- shall be deposited by petitioner before learned trial Court within a period of three months from passing of this order. It is also directed that in default of payment of fine by the petitioner, he shall undergo further simple imprisonment of three months."

Learned counsel for the accused-applicant submits that due to insufficient residential address of the applicant, learned counsel could not inform the applicant about the said order. Learned counsel further submits that now he is in contact with the applicant, therefore, some time may be granted to deposit the amount of fine i.e. Rs.1,000/- ordered by this Court vide order dated 02.07.2025.

Per contra, learned Deputy Government Advocate opposes the present miscellaneous application.

Heard and perused the record.

Looking to the facts and circumstances of the case, two weeks' further time from the passing of this order is granted to the accused-applicant to deposit the amount of fine i.e. Rs. 1,000/- as ordered by this Court vide order dated 02.07.2025. It is also directed that the accused-applicant shall deposit the amount of fine on or before 27.01.2026.

Accordingly, this criminal miscellaneous application stands disposed of.
