This criminal appeal under Section 14A of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989 (hereinafter to be referred as 'the SC/ST Act’) has been filed on behalf of the appellant being aggrieved with the order dated 21.04.2026 passed by the learned Special Judge, S.C./S.T. (Prevention of Atrocities Cases), Kota (hereinafter to be referred as ‘trial court’) in FIR No.215/2024 registered at Police Station Borkheda, District Kota City for the offence under Sections 420, 467, 468, 471 and 120B of IPC, whereby the trial court has dismissed the bail application filed on behalf of the appellant.

Heard the learned counsel for the appellant, learned Public Prosecutor as well as learned counsel for the complainant and perused the material on record.

Learned counsel for the appellant submits that the appellant has falsely been implicated in this case. It is further submitted that the FIR specifically names five persons, and the appellant is not named therein. Learned counsel submits that the only allegation against the appellant is that he signed the sale deed dated 15.02.2024 as an attesting witness. It is further submitted that the appellant is neither a beneficiary under the said sale deed nor a party to any agreement. The appellant has been in judicial custody since 02.04.2026 and has four criminal antecedents. Charge-sheet has been filed. Therefore, the appeal presented by the present appellant may be allowed.

Learned Public Prosecutor and counsel for the complainant have vehemently opposed the appeal. 5. Considering the facts and circumstances of the case and without commenting anything on the merits/demerits of the case, I deem it just and proper to allow the appeal filed by the appellant under Section 14-A of SC/ST Act.

Accordingly, this criminal appeal filed under Section 14-A of SC/ST Act is allowed and order dated 21.04.2026 passed by the learned trial court is set aside. It is directed that appellant- Bhanwar Singh S/o Jodhraj, shall be released on bail provided he shall execute a personal bond in a sum of Rs.50,000/with two sound and solvent sureties of Rs.25,000/- each to the satisfaction of learned trial court for his appearance before that
