Present petition is filed with the following prayers:

“i. The Respondent no.3 may kindly be directed to release the original documents of the Petitioner, enabling the Petitioner to peruse his Super Speciality Course.

ii. Allow the Petitioner to furnish an undertaking before this Hon’ble Court, to serve the remaining bond period strictly in accordance with the terms of the bond, and/or;

iii. Any other appropriate order or direction which this Hon’ble Court deems just and proper in the facts and circumstances of this case may kindly also be passed in favour of the Petitioner.”

Learned counsel for the petitioner has submitted that a time period of four days may be given to the petitioner to submit original documents in order to pursue Super Speciality course.

After arguing for a while, learned counsel for the parties have drawn consensus inter-se them that documents can be released with the following conditions, which reads as under:

“a. The candidates shall submit and undertaking before the Hon’ble Court and affidavit before the concerned authority that after the completion of the respective higher course, he/she shall resume the services and shall finish the remainder period of the bond and on failing to do so, they shall deposit the amount of the bond as agreed.

b. The concerned candidate shall apply for release of the documents alongwith proof of this selection and allotment and on submission of the aforesaid affidavit.”

In light of the above said terms and conditions so agreed by the learned counsel for the petitioner as well as respondents, this Court deems it apposite to allow the present petition with the direction that the terms and conditions be complied with by the respective parties. Arrangements qua compliance of the directions be made forthwith.

Accordingly, the present petition is allowed. Pending applications, if any, shall stand disposed of.
