This writ petition has been filed by the petitioners with the

following prayer:-

¶38

“i) the Impugned action of respondent authorities in not declaring and operating the waiting list and not according appointment to humble petitioners on the post of Medical Officer in pursuance to advertisement dated 20.05.2022 and impugned DOP circular dated 27.12.2021 Issued by DOP, may kindly be declared illegal and arbitrary and therefore the

same may kindly quashed and set aside on this ground alone.

ii) The respondents may kindly be directed by issuing writ of mandamus, order or direction in the nature thereof:-

¶44

a) To declare the waiting list and operate the waiting/ reserve list against non-joiners for appointment on the post of Medical Officers in pursuance to advertisement dated 20.05.2022; and

¶45

b) to give appointment to humble Petitioners on the post of Medical Officers with all consequential benefits in pursuance to the advertisement dated 20.05.2022.”

During course of arguments, learned counsel for petitioners submits that the petitioners may be granted permission to file an appropriate representation before the respondentsAuthority to consider and resolve their grievances.

¶47

Considered the grievance raised herein, the petitioners are given a liberty to submit a representation to the respondents-Authority within a period of 30 days raising all grounds and the respondents-Authority are directed to consider and decide the representation after enquiry about grievances, raised by the petitioners but with a reasoned and speaking order within a period of 30 days from date of receipt of representation. After the order, the respondents are under an obligation to communicate the decision to the petitioners either by way of speed post or through E-mail, if petitioners have provided E-mail in their representation. If the petitioners are still aggrieved, they are at liberty to approach this Court with fresh petition.
