Instant writ petition has been filed by the petitioners with following prayers:

“It is, therefore, most respectfully prayed that your lordship may graciously be pleased to accept and allow this Writ petition and (i) by appropriate writ, order or direction, respondents may directed to make notional pay fixation of petitioners and give them seniority form the date of appointment

has been given to other persons selected through same process in the larger interest of justice. (ii) Issue any other writ order or direction, which this Hon'ble Court deems fit and proper, may kindly be passed in favour of the petitioners. (iii) Cost of the writ petition be also awarded in favour of the petitioners.”

Learned counsel for petitioner while referring and relying upon judgment dated 07.11.2025 in S.B. Civil Writ Petition No. 21834/2025 titled as “Chanda Kanwar Kaviya Vs. The State of Rajasthan & Ors.” submits that the controversy and the issue raised herein is already settled by a Co-ordinate Bench of this Court, in case of Manoj Khandelwal & Ors. Vs. State of Rajasthan & Ors: SBCWP no. 7283/2014 decided on 16.07.2024.. He further submitted that instant writ petition be disposed of in accordance with ratio laid down in case of Manoj Khandelwal (supra).

Having considered the submissions of learned counsel for parties and also material placed on record, the writ petition is disposed of in light of Chanda Kanwar Kaviya (supra) passed by this Court, at Principal Seat, Jodhpur on basis of ratio laid down in case of Manoj Khandelwal & Ors. Vs. State of Rajasthan (supra).

Considered the grievance raised herein, the petitioners are given a liberty to submit a representation to the respondentsAuthority within a period of 30 days raising all grounds and the respondents-Authority are directed to decide the representation in light of ratio laid down in case referred hereinabove with a reasoned and speaking order within a period of 30 days from date of receipt of representation. After the order, the respondents are

under an obligation to communicate the order to the petitioners either by way of speed post or through E-mail, if petitioners have provided E-mail in their representation. If the petitioners are still aggrieved, they have a liberty to approach this Court with fresh petition.

In case the ratio laid down in aforementioned is applicable, the petitioners are entitled to benefit as extended in case of

Manoj Khandelwal (supra).

With the aforesaid directions, the present writ petition with pending application, if any, stands disposed of.
