The present petition has been filed by the petitioner with the following prayers:-

"It is, therefore, humbly prayed that this writ petition may kindly be allowed and by issuing a writ, order or direction:i) further, the respondents may kindly be directed not to allot the fair price shop of the petitioner's area (Gram Panchayat Sankotda) to some other person in furtherrance of impugned notification No. 987 dated 04.09.2025 and impugned notification may kindly be quashed and set aside qua the shop of the petitioner situated at Gram Panchayat Sankotda;

ii) the respondents may kindly be directed to follow the observations of Hon'ble Rajasthan High Court, Bench Jaipur passed in order dated 06.02.2017 in S.B. Civil Writ Petition No. 9137/2016 "Neeraj Sharma & ors. Vs. State of Rajasthan & Ors. before appointing the new fair price shopkeeper;

iii) Any other order which this Hon'ble Court deems proper may also be granted in favour of the petitioner."

Learned counsel for the petitioner argued that the present petition may be disposed of at this stage in the light of the order dated 19.09.2025 passed by the Coordinate Bench of this Court in S.B. Civil Writ Petition No.14468/2025 and the petitioner may be given liberty to file representation before the competent authority i.e. District Collector.

In the light of submissions made by learned counsel, this Court deems it proper to dispose of the present petition with a direction that the petitioner or aggrieved parties to mark their appearance before the concerned District Collector as per the recommendation of Hon’ble Mr. Justice D.P. Wadhwa Committee (more specifically in para-19 of the said report) on 15.12.2025 at and around 11:00 am and after giving due audience, speaking order will be passed by the competent authority.

This Court makes it clear that till passing of orders, the allotment of the shop qua the disputed site will be kept in abeyance; passing of this order will not cause any prejudice to either of the sides.

The present petition is accordingly, disposed of. Pending applications, if any, stand disposed.

Appropriate remedy will be available to the petitioner, if he is aggrieved by the order passed by the District Collector.
