Matter has come up on application (IA No.1/2025) filed by the respondent No.3.

This writ petition has been filed by the petitioner against order dated 29.01.2020 passed by the Additional Civil Judge and Metropolitan Magistrate No.25, Jaipur Metropolitan, Headquarter Chomu in pending Civil Suit No.82/1985.

It is submitted in the application by respondent No.3 that during the pendency of the instant petition, the application under Order 7 Rule 11 of CPC filed by the defendants has been allowed by the trial Court vide order dated 22.11.2023 and the plaint has been returned to the plaintiff for filing the same before the competent Court.

Copy of order dated 22.11.2023 is also placed on record along with application.

There is no one on behalf of learned counsel for the petitioner to controvert the aforesaid factual position.

In view of above, the petition filed by the petitioner is dismissed.

Accordingly, the application is disposed of.
