This petition has been filed under Article 226 of Constitution of India for quashing of order dated 12.11.2024 passed by Learned District Collector, District Deeg by which learned District Collector has ordered for releasing the vehicle of the petitioner bearing registration No. RJ-05-GB-7666 but has imposed a fine of Rs.2,00,000/- to be deposited in the Treasury before releasing of the said vehicle.

Learned counsel for the petitioner submits that the petitioner is the registered owner of the vehicle. The seized vehicle is required by petitioner for his use. The petitioner is a poor person

and the impugned order may be modified and the condition of depositing the amount of Rs.2,00,000/- as fine be waived.

Learned Public Prosecutor has opposed the prayer made by learned counsel for the petitioner.

Heard and perused the material available on record.

The vehicle of the petitioner was seized on 24.02.2024 since then the vehicle is lying idle at police station for almost one year and is being deteriorated.

Therefore, taking into consideration the facts and circumstances of the case, the order dated 12.11.2024 passed by District Collector, District Deeg is modified, the fine of Rs.2,00,000/- imposed by the District Collector, District Deeg is waived and rest part of the order dated 12.11.2024 shall remain same.

With the above direction, the petition is disposed of.
