This Criminal Miscellaneous Petition has been filed under Section 528 of B.N.S.S. 2023 for quashing of FIR No.163/2024 registered at Police Station Andhi, District Jaipur Rural, Rajasthan for the offences punishable under Sections 74 & 76 of BNS, 2023 mainly on the ground that the parties have entered into compromise and amicably settled their dispute and now no dispute remains between them.

During the pendency of the petition, petitioner and victimrespondent no.2 appeared before this Court on the last date of hearing on 12.12.2024 and submitted that both the parties have settled their dispute amicably, therefore, both the parties ere

directed to appear before the Investigating Officer and the Investigating Officer was directed to verify the factum of compromise and submit its report before this Court.

Learned Public Prosecutor has submitted the factual report dated 04.01.2025 sent by the Police Station Andhi, District Jaipur Rural in which it has been mentioned that both the parties have settled their dispute amicably. The complainant was also examined by the Investigating Officer in which complainant-respondent no.2 has stated that the FIR was registered on some misunderstanding and she does not want any action against the petitioner. Compromise has been duly verified by the Investigating Officer.

Heard learned counsel for the parties and perused the material available on record. 5. In view of the aforesaid and considering the submissions made on behalf of the respective parties and the material made available for my perusal, this Court feels that in order to establish harmony between the petitioner and the complainant and give quietus to the litigation, it would be expedient that the impugned FIR is quashed.

The present case is wholly covered by the principle of law laid down by Hon'ble the Supreme Court in the case of Gian Singh Vs. State of Punjab & Anr.-reported in 2012 Cr.L.J. (SC) 4934 and in the case of State of Haryana & Ors. Vs. Choudhary Bhajan Lal & Ors. [AIR 1992 SC 604], the FIR is liable to be quashed in view of compromise arrived at between the parties although the offences are non-compoundable.

In view of the above, this criminal miscellaneous petition is allowed and FIR No.163/2024 registered at Police Station Andhi, District Jaipur Rural, Rajasthan is quashed and all other proceedings arising out thereof are also quashed. Consequence to follow.
