By way of filing this criminal misc. petition, a challenge has been led to the impugned FIR No.75/2025 registered with Police Station Bander Sindri, Ajmer against the petitioners for the offences punishable under Sections 318(4), 61(2) of BNS and under Sections 3 and 7 of the Essential Commodities Act, 1955 and under Section 19 of the Fertilizer (Control) Order 1985.

At the outset, this Court has observed that with regard to the same prayer, the petitioners have already approached this Court by way of filing S.B. Criminal Misc. Petition No.3545/2025 with the same prayer, which reads as under:-

“It is, therefore, prayed that your lordships may very graciously be pleased to accept this criminal misc. petition and the FIR No.75/2025 pending investigation before police station Bandarsindri, District Ajmer for the offence under Sections 318(4), 61(2) of BNS, 2023, Sections 3 & 7 of Essential Commodities Act, 1955 and Section 19 of the Fertilizer (Control) Order 1985 may kindly be quashed and set-aside and any subsequent development after the registration of the abovementioned complaint against the petitioner may also be quashed and set aside.

Any other appropriate order or directions, which this Hon’ble Court may deem just and proper in the facts and circumstances of the case, may also be passed in favor of the petitioner.”

When the aforesaid matter was listed before the co-ordinate Bench of this Court on 15.07.2025, the aforesaid petition was withdrawn with the following liberty:-

“Learned counsel for the petitioner wants to withdraw the present matter with liberty to approach the appropriate forum, if need so arises in the future.

The present petition is accordingly, dismissed as withdrawn with liberty as prayed for. Pending applications, if any, stand disposed.”

Now the successive criminal misc. petition with regard to the same prayer has been submitted for quashing of the FIR.

In the considered opinion of this Court, the successive misc. petition with regard to the same prayer is not maintainable, hence, this misc. petition is dismissed on this count alone.

Stay application as well as all applications (pending, if any) stand disposed of.
