By means of filing of instant criminal misc. petition under Section 528 of BNSS, 2023, petitioner has impugned the interlocutory order dated 03.06.2025 passed by the Additional Chief Judicial Magistrate, Nadbai, District Bharatpur in Criminal Case No. 428/2022, declining to interfere with the order of cognizance taken against the petitioner vide order dated 13.09.2022 for offences under Section 138 of the NI Act, on the Criminal Complaint filed by the respondent.

The contention of counsel for petitioner is that in respect of misusing of cheques in question, on the behest of petitioner one FIR No. 184/2022 at Police Station Lakhanpur, District Bharatpur came to be lodged for offences under Sections 379, 467 and 468

of IPC wherein after investigation, charge-sheet for alleged offences has been filed against the complainant and criminal case is pending before the Court of Additional Chief Judicial Magistrate, Nadbai, District Bharatpur.

Counsel for petitioner, after arguing for some time, seeks permission to withdraw this petition with liberty to move an application before the concerned Sessions Judge to make a prayer to club both the criminal cases and to run the trial together. 4. In view of above, instant petition stands disposed of with liberty as prayed for. 5. Stay application and other pending application(s), if any, also stand disposed of.
