Criminal Miscellaneous (Petition) No. 4054/2025: By an interim order dated 14-07-2025 in a petition under Section 528 BNSS, the investigating officer had been directed to verify whether the sale deed relied upon by the petitioners-accused was forged, and protection had been extended to them. On the petitioners' own recall application, and on respondent No. 2's objection that the accused never produced the original deed and that accused Islamudin Khan had lodged an FIR dated 15-05-2025 at P.S. Civil Lines, Ajmer alleging loss of the documents, the Court found that ownership of the disputed property vests in the respondent, that the accused had no valid title and had alienated the property to third persons without lawful transfer of ownership, and that a sale deed by itself confers no authority to sell. Finding no prima facie material to quash the FIR, the Court recalled the protection granted by the order dated 14-07-2025, dismissed the Section 528 BNSS petition, and directed the investigating officer to investigate in accordance with law and to take action under the statutory provisions if any offence is made out against the accused.
