Rajendra Singh S/O Mangal Singh Vs State of Rajasthan

The instant second bail application has been filed under Section 483 BNSS on behalf of accused-petitioner. Learned counsel for the accused-petitioner submits that the accused-petitioner has falsely been implicated in this case. He further submits that the first bail application of the accusedpetitioner was dismissed with the liberty to file afresh filing of the charge-sheet. The police has charge-sheeted the accusedpetitioner under Sections 318(4), 316(2) and 61(2)(a) of BNS. Against the petitioner in similar offences another FIR has been lodged, however, the petitioner has been enlarged on regular bail by the co-ordinate Bench in S.B. Criminal Misc. Bail Application

No.538/2025 in FIR No.476/2024, registered at Police Station Sewar, District Bharatpur (Raj.) and in S.B. Criminal Misc. Bail Application No.9343/2024 in FIR No.482/2024 registered at Police Station Mathura Gate, District Bharatpur under Sections 420 and 406 of IPC, has been enlarged on anticipatory bail. The accusedpetitioner is in custody since 23.08.2025 and the matter is exclusively triable by Magistrate and trial of the case may take considerable time, therefore, the second bail application of the accused-petitioner may be allowed.

Learned Public Prosecutor has vehemently opposed the second bail application and contended that the first bail application of the accused-petitioner was dismissed on 16.09.2025. The petitioner is involved in similar cases and has sold the same property of the complainant to the other persons. Apart from this, 2 FIR's have been registered against the petitioner, therefore, the second bail application of the accused-petitioner may be dismissed.

Heard and perused the material available on record.

Considering the fact that the offences alleged against the accused-petitioner are exclusively triable by Magistrate, the accused-petitioner is in custody since 23.08.2025 and the trial of the case may take considerable time, without commenting anything on the merits of the case, I deem it just and proper to enlarge the accused-petitioner on bail.

Accordingly, the second bail application under Section 483 BNSS is allowed and it is ordered that the accused-petitioner Rajendra Singh S/o Mangal Singh, in connection with FIR No. 330/2025 registered at Police Station Mathuragate, District

Bharatpur, shall be enlarged on bail provided he furnishes a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the learned trial Judge for his appearance before the court concerned on all the dates of hearing and as and when called upon to do so.

The accused-petitioner is also directed to mark his presence on 25^th of every month till conclusion of trial before the concerned police station. The SHO of the concerned police station is directed to maintain a regular register marking the presence of the accused-petitioner and shall send the presence report of the accused-petitioner on the same day to the concerned Trial Court without any delay. In case of any breach to the above condition, the learned Public Prosecutor shall be free to move the application against the petitioner for cancellation of the bail before the concerned Court.
