Petitioner has invoked inherent jurisdiction of this Court under Section 482 Cr.P.C. for quashing of F.I.R. No.199/2018 lodged at Police Station Bonli, Sawai Madhopur, under Sections 363 & 366 IPC against the petitioner.

Bare perusal of FIR would reveal that informant Pukhraj S/o Gordhan levelled allegations that his daughter Smt. Lali was abducted by the petitioner.

This Court vide order dated 13.07.2018, directed the Registrar (Judicial) to record the statements of Smt. Lali, the alleged victim. Accordingly, statements of victim-Smt. Lali were

recorded by the Registrar (Judicial) on 13.07.2018 itself which are as under:

In view of the above statements made by the victimSmt. Lali that she has performed marriage with the petitioner and has been living a happy married life with him and even a certificate of Registration of Marriage declaring that the marriage was solemnised on 22.06.2018 has been placed on record by the petitioner, this Court finds that under the circumstances, prosecuting the petitioner pursuant to the impugned FIR would be a futile exercise and would also cause miscarriage of justice to the petitioner. Hence, this Court deems it just and proper, in the interest of justice to quash and set aside F.I.R. No.199/2018 lodged at Police Station Bonli, Sawai Madhopur.

Accordingly, the Criminal Miscellaneous Petition stands allowed.
