The instant bail applications have been filed under Section 483 BNSS on behalf of accused-applicants. The accusedapplicants were arrested in connection with FIR No. 409/2025 registered at Police Station Shivdaspura Jaipur City (South) for the offence(s) under Sections 8/22 NDPS Act.

Learned counsel for the accused-applicants submits that the applicants are sole bread earner of their family, aged 31 and 35 years. It is submitted that there are no criminal antecedents registered against the applicants and they are in custody ever since 09.06.2025. It is further submitted that as per

the best information of the counsel, charge-sheet has been filed. It is also submitted that recovered quantity of the contraband is slightly higher than the commercial quantity and if weight of packaging is removed, the quantity is below than the commercial quantity. Learned counsel further submits that the conclusion of trial is likely to take a long time and no useful purpose would be served by keeping the applicants behind bars till disposal of the case.

Per contra , learned Public Prosecutor has vehemently opposed the bail applications.

Considering the arguments advanced by the counsel for the parties, considering that accused-applicants are sole bread earner of their family; that charge-sheet has been filed; that there are no criminal antecedents registered against the applicants; that applicants are in custody ever-since 09.06.2025; that the weight of the contraband along with the packaging material is slightly higher than the commercial quantity as prescribed in the NDPS Act and looking to the overall facts and circumstances of the case and material on record but without commenting on merits/demerits of the case, this court is inclined to allow the bail applications of the accused-applicants and enlarge them on bail.

Accordingly, the bail applications under Section 483 BNSS are allowed and it is ordered that accused-applicants 1. Indrapal S/o Shri Narayan Lal and 2. Shambhu Lal S/o Shri Peerulal shall be enlarged on bail provided each of them furnishes a personal bond of Rs.50,000/- with two sureties of Rs.25,000/each to the satisfaction of learned trial Judge for their appearance before the court concerned on all the dates of hearing as and when
