The instant second bail application has been filed under Section 483 BNSS on behalf of accused-petitioner. The petitioner has been arrested in connection with FIR No.169/2024 registered at Police Station Jaipur Airport, District Jaipur City (East) for the offence(s) under Sections 318(2), 319(2) and 316(2) of BNS and Section 66D of IT Act.

Learned counsel for the accused-petitioner submits that the accused-petitioner has falsely been implicated in this case. He further submits that the first bail application of the accusedpetitioner was dismissed by this Court vide order dated 27.11.2024, thereafter, the police has submitted the charge-sheet against the accused-petitioner before the concerned Court. The offences alleged against the petitioner are triable by Magistrate.

The other co-accused Saleem Ahmed @ Sam and Ghanshyam Singh have already been enlarged on bail vide order dated 27.11.2025. The accused-petitioner is in custody since more than 10 months and the trial of the case may take considerable time, therefore, considering the above facts, the second bail application of the accused-petitioner may be allowed.

Learned Public Prosecutor has vehemently opposed the second bail application of the accused-petitioner and contended that the accused-petitioner has siphoned off huge amount and deceived the complainant. The petitioner has maintained two accounts in which around Rs.28,00,000/- were deposited, therefore, considering the gravity of the offence, the second bail application of the accused-petitioner may be dismissed.

Heard and perused the material available on record. 5. The first bail application of the accused-petitioner was dismissed on 27.11.2024, thereafter, the charge-sheet has been produced before the concerned Court. The accused-petitioner is in custody since more than 10 months and further trial of the case may take considerable time. There are no criminal antecedents against the accused-petitioner. The accused-petitioner is a resident of Jaipur and the case is also pending before the Trial Court at Jaipur. Therefore, without commenting anything on the merits of the case and considering the long custody period of the petitioner, I deem it just and proper to enlarge the accusedpetitioner on bail.

Accordingly, the second bail application under Section 483 BNSS is allowed and it is ordered that the accused-petitioner

Chandra Prakash Agrawal S/o Sh. Radheyshyam Agrawal, in connection with FIR No.169/2024 registered at Police Station Jaipur Airport, District Jaipur City (East) shall be enlarged on bail provided he furnishes a personal bond in the sum of Rs.50,000/with two sureties of Rs.25,000/- each to the satisfaction of the learned trial Judge for his appearance before the court concerned on all the dates of hearing and as and when called upon to do so.
