The present S.B. Criminal Misc. Petition is filed under Section 528 BNSS for quashing the FIR No.258/2025 registered at Police Station Sikandara, District Dausa for offences under Sections 115(2), 126(2), 137(2), 127(2) & 307 of BNS and 3(1)(r) & 3(1) (s) of SC/ST Act.

The compromise entered between the parties is placed on record as annexure-2. Learned counsel Mr. Ankit Khandelwal, is present on behalf of the complainant- Satveer Bairwa. The complainant- Satveer Bairwa is also present in person before this Court and concedes that he has executed an agreement with the petitioner and it bears his signature and if the proceedings against the petitioner are quashed then he has no objection. The

complainant is being identified by the learned counsel for the petitioner and has no objection, if the proceedings are quashed.

Heard and perused the material available on record.

The petitioner and injured Satveer Bairwa have entered into compromise and it bears their signatures. The allegation against the petitioner are not grave and the injuries sustained to the complainant is not grievous or dangerous to life as the FIR itself was registered under Section 115(2), 126(2), 137(2), 127(2) & 307 of BNS and 3(1)(r) & 3(1)(s) of SC/ST (Prevention of Atrocities Act). Therefore, in the light of the judgment passed by the Hon’ble Apex Court in Gian Singh Vs. State of Punjab [(2012) 10 SCC 303] and Ramawatar Vs. The State of Madhya Pradesh reported in AIR 2021 SC 5228 , this Court deems it proper to quash the proceedings on the basis of compromise entered between the parties and the FIR No.258/2025 registered at Police Station Sikandara, District Dausa with all consequential proceedings, are hereby quashed and set aside.

Accordingly, the instant petition is allowed. Pending application(s), if any, stand disposed of.
