The instant bail application has been filed under Section 483 BNSS on behalf of accused-petitioner. The accused-petitioner has been arrested in connection with FIR No. 195/2025 registered at Police Station Anta, District Baran for the offences under Sections 310(4) and 310(5) of BNS and Sections 3/25 and 4/25 of Arms Act.

Learned counsel for the accused-petitioner submits that the accused-petitioner has falsely been implicated in this case. It is argued that similarly placed co-accused Bablu @ Deepak against whom 13 criminal cases were pending has already been enlarged on bail by learned District and Sessions Judge, Baran vide order dated 08.08.2025 and the case of the present petitioner is akin to the other co-accused, who has already been enlarged on bail. The accusedpetitioner is in custody since 31.05.2025 and the trial of the case may take considerable time, therefore, the bail application of the accused-petitioner may be allowed.

Learned Public Prosecutor has vehemently opposed the bail application and contended that petitioner alongwith the other coaccused apprehended red handedly, making plan for committing dacoity and from their possession arms were also recovered. It is also contended that petitioner is a habitual offender and against him 3 criminal cases were registered out of which one is for the offences under Section 302 of IPC, therefore, considering the above facts, bail application of the accused-petitioner deserves to be dismissed.

Heard and perused the material available on the record. 5. Considering the fact that the learned District and Sessions Judge, Baran has allowed the bail application of co-accused Bablu @ Deepak, against him 13 criminal cases were pending. The accusedpetitioner is in custody since long and the trial of the case may take considerable time, without commenting anything on the merits of the case, I deem it just and proper to enlarge the accused-petitioner on bail.

Accordingly, the bail application under Section 483 BNSS is allowed and it is ordered that the accused-petitioner Rohit S/o Nawal Kishore, in connection with FIR No. 195/2025 registered at Police Station Anta, District Baran shall be enlarged on bail provided he furnishes a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the learned trial Judge.

The accused-petitioner is also directed to mark his presence on 25^th of every month till conclusion of trial before the concerned police station. The SHO of the concerned police station shall send the presence report of the accused petitioner on the same day to the trial court every month. In case of any breach to the above

condition, the learned Public Prosecutor shall be free to move the application against the petitioner for cancellation of the bail before the concerned Court.
