The petitioners have preferred these bail applicationsr under Section 483 of BNSS in FIR No.11/2025 registered at Police Station-Chhipa Barod, District-Baran for the offence under Sections 126(2), 115(2), 109(1), 333 and 189(2) of BNS.

Since all these bail applications arise out of a common FIR, they are being decided by this single order.

Heard learned counsel for the petitioners as well as learned Public Prosecutor and perused the material available on record.

Learned counsel for the petitioners submits that the petitioners have falsely been implicated in this case. It is further submitted that although allegation is that the injured sustained 28 injuries but none of these injuries were caused by a sharp-edged weapon. As per medical opinion, all the injuries were caused by blunt weapon. There is no medical opinion on record indicating that any

of the injuries are dangerous to life. Counsel further submits that, according to the medical report, there is no evidence of any injury on any vital organ and therefore, the injuries documented in the medical record cannot be considered life-threatening. Petitioners are behind the bars since 29.01.2025. The trial of the case may take considerable time, therefore, no fruitful purpose would be served by keeping the petitioners in further custody, hence the bail application of the petitioners may be allowed. 5. Learned Public Prosecutor has vehemently opposed the bail application.

On consideration of the rival submission and material available on record and deliberating all the facts and circumstances of the case, but without expressing any opinion on the merits/demerits of the case, I am inclined to grant benefit of bail to the petitioners. 7. Accordingly, the bail application under Section 483 B.N.S.S. is allowed and it is ordered that the petitioners- Sudama Kirad S/o Murari, Jitendra Pankaj @ Jeetu @ Gotiya S/o Ramkishan, Fareed Urf Kalia S/o Khaleel, Sandeep Bairwa S/o Jamnalal and Deva S/o Ranjeet shall be released on bail on their furnishing a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the learned trial court for their appearance before that Court on all the dates till conclusion of the trial.
