These instant bail applications have been filed under Section 483 BNSS on behalf of accused-petitioners. The petitioners have

been arrested in connection with FIR No. 33/2024 registered at Police Station Special Police Station SOG, District ATS and SOG for the offence(s) under Sections 420, 467, 468, 471 and 120-B of IPC and Section 66-D of IT Act.

Learned counsels for the accused-petitioners submit that the accused-petitioners have falsely been implicated in this case. The offences alleged to have been committed by the accusedpetitioners are triable by Magistrate. The accused-petitioners are in custody since long and the trial of the case may take considerable time. The charge-sheet has already been produced before the concerned trial court, therefore, these bail applications of the accused-petitioners may be allowed.

Learned Public Prosecutor has vehemently opposed the bail applications and contended that petitioners prepared forged Taekwondo certificates and thereafter provide it to other coaccused and received huge amount in their bank accounts. Against both the accused petitioners two other FIRs were registered for the offences under Sections 420, 467 and 468 of IPC, therefore considering the above facts, these present bail applications deserves to be dismissed.

Heard and perused the material available on record.

Considering the arguments advanced by learned counsels for the petitioners and looking to the fact that the offences alleged to have been committed by the accused-petitioners are triable by Magistrate. The accused-petitioners are in custody since long and the trial of the case may take considerable time, without

commenting anything on the merits of the case, I deem it just and proper to enlarge the accused-petitioners on bail.

Accordingly, these bail applications under Section 483 BNSS are allowed and it is ordered that the accused-petitioners 1. Dinesh Jagarwal S/o Shri Onkarmal, 2. Kamal Singh S/o Shri Revti Singh, in connection with FIR No. 33/2024 registered at Police Station Special Police Station SOG, District ATS and SOG shall be enlarged on bail provided each of them furnish a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the learned trial Judge.

The accused-petitioners are also directed to mark their presence on 25^th of every month till conclusion of trial before the concerned police station. The SHO of the concerned police station shall send the presence report of the accused petitioners to the trial court on the same day every month. In case of any breach to the above condition, the learned Public Prosecutor shall be free to move the application against the petitioners for cancellation of the bail before the concerned Court.
